This document hereafter referred to as the User Agreement shall be an Offer as defined by Article 437 of the Civil Code of the Russian Federation. The use by the Customer of the online service for purchasing the services of the Museum rendered by the Museum at the place of the address of the Volga-and-Vyatka Branch of the A. S. Pushkin State Museum of Visual Arts shall be deemed in accordance with Article 438 of the Civil Code of the Russian Federation an unconditional acceptance of the Offer by the Customer.

This Offer shall explicate the conditions of purchasing the services of the Museum through the official site of the Volga-and-Vyatka Branch of the A. S. Pushkin State Museum of Visual Arts at https://arsenal-museum.art/. Acting to purchase the services rendered by the Museum, the Customer thereby shall fully and unconditionally accept and be deemed responsible for following the conditions of this Agreement.

1. Basic Terms

  1. Museum: The Federal State-run Budgetary Cultural Facility “Volga-and-Vyatka Branch of the A. S. Pushkin State Museum of Visual Arts”
  2. Customer: a private person (or an authorized representative of a legal entity) who purchases the Museum’s services at the ticket offices or through the official site.
  3. Parties: the Museum and the Customer.
  4. Agreement: this User Agreement.
  5. Site: the website of the Museum located at the URL https://arsenal-museum.art/.
  6. Ticket offices: ticket offices of the Federal State-run Budgetary Cultural Facility “Volga-and-Vyatka Branch of the A. S. Pushkin State Museum of Visual Arts” located at the place of the address of the Volga-and-Vyatka Branch of the A. S. Pushkin State Museum of Visual Arts.
  7. Event: an event held by the Museum including offering to the visitors an opportunity to view exhibitions set up by the Museum, lectures, concerts, guided tours, and any other event which can be attended only through acquiring a ticket.
  8. Day of the visit: the day of actual receiving of the Museum’s services.
  9. Ticket system: hardware and software system designed for distribution of tickets from the ticket offices and at the site of the Museum.
  10. Ticket: a document executed as prescribed by the Ministry of Culture of the Russian Federation with a bar code or a QR code; in combination with the till slip, it shall verify the right of the bearer of such combination to a visit of an event. The ticket can either be printed on the typographically manufactured accountable form (hard-copy ticket), or created through the ticket system (electronic ticket). The ticket can be personalized, i. e. specify personal information of the bearer (family name, name, and patronymic), and grant the right to entry only to the individual specified (requiring to produce an ID for ticket inspection).
  11. Order (digital order): one or several tickets for one event chosen by the Customer and united in the ticket system under the unifying unique number (number of the order), based on which the tickets are being reserved on the site.
  12. Ticket reservation: a short-term reservation (withdrawal from the open sale on the site for prevention of doubling of sales) of the number of tickets specified by the Customer when creating the digital order starting from the moment of creation of the order (by pressing the button Order the tickets the Customer thereby shall affirm that they have accepted the conditions of this Agreement) to the moment of the payment for the digital order or the Customer’s refusal thereof which can be expressed through, among other things, the omission of action by the Customer aimed at confirmation of and/or payment for the digital order.
  13. Reservation term: the stipulated by this Agreement time span on expiry of which, if the Customer omits to take action aimed at confirmation of and/or payment for the digital order, the reservation shall be annulled and tickets returned to the open sale.
  14. Number of the order: the unifying unique number of the digital order in the ticket system. This number shall be the basis for the query for the order details.
  15. Bank card: an instrument for operations with the funds placed with the bank having issued the card in accordance with the effective law of the RF and the agreement with the issuer bank.
  16. Online payment system: the system used for facilitating payments between the Museum and the Customer when purchasing tickets with the help of Apple Pay, Google Pay, or other digital payment services.
  17. Acquirer bank: the bank which services the Museum’s operations as regards payments for the Museum’s goods and services performed with the use of bank cards on the Internet.
  18. Payment or Settlement: a transfer of funds either in physical currency, or with the help of the bank card or through an online payment system to the Museum amounting to the cost of the tickets.
  19. Payment system: a number of financial institutions united through agreements and providing interactions which are necessary for settlements between the Customer and the Museum.
  20. Rules of payment systems: a collection of documents regulating the operation of the payment systems such as VISA, MasterCard, MIR, and the online payment systems.
  21. Price: the amount of currency to be paid for one article of the Museum’s service.
  22. Cost: the sum total of prices for all Museum’s services ordered by the Customer.
  23. Till slip (fiscal receipt): a document enumerating details as stipulated by the Federal Law of 22.05.2003 No. 54-FZ, On the use of cash tills for payments in physical currencies and/or settlements with the use of bank cards, issued by the Museum with a cash till (CT) and given to the Customer.
  24. Purchase: the process of ordering or reserving of or paying for the Museum’s services at the ticket offices or on the site, the result being issuance of the Ticket and the Till Slip to be handed over to the Customer.
  25. Refund: a conducted as per conditions of this Agreement return of funds paid for the Tickets in physical currency, to the Bank Card, or through the online payment system.
  26. Refund claim (Claim): a number of necessary details on the Customer and the Tickets provided by the Customer for Refunds by filling in either the /digital form of the claim/ found on the site or a paper form at the ticket office.
  27. Inspection: checking of the validity of the ticket with respective hardware-software means.

2. Subject of the Agreement

  1. This Agreement shall govern the relationships between the Customer and the Museum when the Customer purchases the Museum’s services from the ticket office or at the site.
  2. The Agreement is a contract between the Customer and the Museum, regulates the Customer’s use of the Museum’s site, and shall be deemed, in accordance with articles 426–428 of the RF Civil Code, a public deed of adhesion.

3. Coming into Effect

  1. When purchasing the Tickets at the Site this Agreement shall come into effect starting from the moment of pressing of the button confirming the Customer’s consent to the conditions of the User Agreement including the Customer’s consent for the processing of the personal data in the event of purchasing the personalized ticket, and to the Rules of visiting of the Museum.
  2. When purchasing the Tickets from the ticket office the Agreement shall come into effect from the moment when the cashier starts issuing the Tickets following the Customer’s request.
  3. The Museum shall reserve the right to introducing changes to this Agreement without a prior notification of the Customer thereof, and advise the Customer that they should read the text of the Agreement and inform themselves on such changes each time they make a new Order. Starting the process of purchasing the ticket, the Customer thereby shall express their consent to these conditions.

4. The Parties’ Rights and Liabilities

4.1 Rights of the Customer

  1. The Customer shall be entitled to get of their own accord information from the Museum’s official sources regarding Events, prices, types of Tickets, rules of purchase of Tickets, persons and entities authorized by the Museum to sell Tickets, and services rendered in connection with an Event; make their own decision regarding the purchase of the Ticket through full and unconditional consent to the conditions of this Agreement.
  2. The Customer shall be entitled to purchase Tickets at the Site and from the Ticket Offices or claim refunds in accordance with conditions of this Agreement.
  3. The Customer shall be entitled to report their opinion regarding the quality of services rendered by the Museum using the contact information specified on the Site of the Museum.
  4. The Customer shall be entitled to attend Events through purchasing a Ticket.
  5. The Customer shall NOT be entitled to reproduce, make copies or facsimiles of, resell, upload to other sites, use for commercial or advertising purposes the information of the Site including the information regarding the Tickets offered for Purchase and their prices.

4.2 Liabilities of the Customer

  1. The Customer shall fully comply with the conditions of the Agreement.
  2. The Customer shall make themselves informed regarding the changes introduced to this Agreement and the rules and conditions of purchase of Tickets.
  3. The Customer shall use the Site with a bona fide intent only for the purposes which do not contradict the conditions of the Agreement and in the manner prescribed by the Agreement. The Customer may not use any software for modification of the Site’s data, nor any other means facilitating an unauthorized access to the Site’s features or functionality.
  4. The Customer shall purchase Tickets only for non-commercial personal use.
  5. On demand by the Museum, the Customer shall produce a valid ID when purchasing a Ticket, claiming Refunds, or at the Ticket Inspection.
  6. On demand by the Museum, the Customer shall produce a document confirming their right to purchasing a Ticket at a reduced price, either when purchasing a reduced-price Ticket from the Ticket Office, or for the Inspection of the reduced-price Ticket.
  7. The Customer shall produce for the Ticket Inspection all details of the Ticket as a clearly-readable hard or digital copy.
  8. The Customer shall make themselves informed regarding the Rules of Conduct in the Museum and follow them during the visit to the Museum or when attending an Event.

4.3 Rights of the Museum

  1. The Museum shall be entitled to modify the prices of the Tickets offered for the Purchase without the prior notification of the other Party; that said, the Cost of the Tickets once purchased by the Customer may not be changed.
  2. The Museum shall be entitled fully of its own accord to set a limit to the number of Tickets purchased and Orders created by the Customer.
  3. The Museum shall be entitled to set different prices and discounts to be paid for visiting exhibitions and the perennial exposition of the Museum.
  4. The Museum shall be entitled to establish a special procedure of Ticket sales for individual Events.
  5. The Museum shall be entitled as part of special programmes or actions to sell Tickets which may not be subjected to Refunds.
  6. The Museum may annul the Customer’s Orders if the Customer breaks the conditions of this Agreement.
  7. The Museum may deny the purchase of the Tickets from the Ticket Office to the Customer who breaks the conditions of this Agreement.
  8. The Museum may deny the right to the visit of an Event to the Customer bearing a Ticket if the Customer violates the conditions of this Agreement, or Rules of Conduct in the Museum or at the Event.
  9. In extraordinary cases, the Museum may demand of the Customer to produce a valid ID when purchasing or claiming a refund for a Ticket or for the Ticket Inspection.
  10. The Museum may demand of the Customer to produce a document confirming that the Customer is entitled to a discount when the Customer purchases a reduced-price Ticket or produces such for the Ticket Inspection.
  11. The Museum can refuse to refund Tickets if the foundation of the Customer’s claim is that the Customer has not liked the Event or did not have enough time to view the entire exhibition before the closing hour of the Museum.
  12. The Museum can reject the Customer’s claim of refund based on the Customer’s disagreement with the changes introduced into the programme of the Event, including changes in the list of the performers, a substitution of a lecturer by a different person, and the like.
  13. The Museum shall be entitled to transfer to persons and entities authorized by the Museum to sell Tickets its right and liabilities as concern the sales of Tickets. In this event, the sales of Tickets shall be governed by the User Agreement drawn by the person or entity to whom said rights and liabilities have been transferred.
  14. The Museum can submit to the Customers informative messages regarding the rules of rendering Services by the Museum (including the rules of creating an Order).

4.4 Liabilities of the Museum

  1. The Museum shall make available for the Customer exhaustive and sufficient (in accordance with the effective law of the RF) information regarding the Event, prices, available types of Tickets, rules of purchase of Tickets, rules and conditions of Refunds, other services rendered in connection with the Event, and the Rules of Conduct in the Museum and at the Event.
  2. The Museum shall grant the Customer an opportunity to purchase Tickets from the Ticket Offices and/or at the Site of the Museum and request Refunds in accordance with the conditions of the Agreement.
  3. The Museum shall grant the Customer right to the Purchase of some types of Tickets at a reduced price from the Ticket Offices and/or at the Site of the Museum on the condition that the Customer shall produce a document confirming their eligibility for the reduced-price Tickets.
  4. The Museum shall specify on the Site and at the Ticket Offices the exact price of all types of Tickets offered for the Purchase.
  5. The Museum shall list all persons and entities authorized by the Museum to sell Tickets.
  6. The Museum may not use personal data of the Customer for the purposes which are not consistent with the provisions of this Agreement.

5. Rules of the Purchase and Refund of the Tickets at the Site

5.1. Currency of Payment and Refund

  1. The Currency of Payment shall be the Russian Rouble as prescribed by the effective law of the RF.
  2. The Currency of Refund shall be the Russian Rouble as prescribed by the effective law of the RF.

5.2. The Payment for the Order at the Site is possible with the help of the Bank Card or Online Payment Systems. At the Ticket Offices the Payment for an Online Order is not available.

  1. Having chosen the Tickets, the Customer shall create the Order by filling in all the fields of the digital form, and expressing their consent to the conditions of the Agreement including the consent to processing of the personal data if purchasing a personalized Ticket and to the Rules of Conduct in the Museum, and then press the button Create order and go over to creating the Order through the step-by-step process.
  2. As the result of a successful Reservation of the Tickets the Customer shall receive an email to the email address specified by the Customer when creating the Order containing a link to the Order.
  3. At any moment preceding the Payment the Customer may reject the unpaid-for Order if they find any provision of this Agreement unacceptable.
  4. The term of Reservation shall depend on the type of the Ticket and shall be indicated at the stage of going over from the Reservation to the Payment. If on expiry of the term the Payment has not been effected, the Reservation is annulled and the Tickets are returned to the open circulation.
  5. The Payment proper for the Order shall take place at the site of the Acquirer Bank or the Online Payment System (when the Customer is automatically redirected to said sites). When the Payment has been successfully effected, the sum amounting to the Cost of the Order shall be withdrawn from the Customer’s account. If the Payment has not been or/and has failed to be effected, the Customer can create another Order and effect the Payment for it as per Clause 5 hereof.
  6. As the result of a successful Payment for the Tickets the Customer shall receive an email to the email address specified by the Customer when creating the Order notifying on the successful Payment for the order with the Electronic Ticket attached or a link to the Electronic Ticket.
  7. The Electronic Ticket shall be deemed delivered if the notification of the Payment for the Ticket has been emailed by the postal server of the Museum. If such email or other messages submitted to the Customer in the process of Reservation of and Payment for the Order, this shall not be construed as the fact that the Ticket has not been reserved or sold, since the failures in sending out emails might happen for a reason outside the scope of the Museum’s control.
  8. If the Customer rejects the Purchase of the Order, the Customer shall be entitled to a Refund of the amount paid for the Order as per Clause 7 hereof.
  9. The Customer shall be entitled to a one-time change of the ownership of the Personalized Ticket.
    • In order to change the ownership of the Personalized Ticket, the Customer shall, within the terms specified for each type of Ticket in Clause 7.1 hereof, submit to the email address of the ticket sales support service (tickets-nn@pushkinmuseum.art) an email with a filled-in form of the application for the change of ownership with the digital copies attached of the identity document of the person who holds the ownership of the personalized Ticket and the identity document of the person to whom the ownership is transferred, and the consent to the processing of the personal data of the person to whom the ownership of the personalized Ticket is transferred.
    • If the personalized Ticket has been issued for a person entitled to a discount, its ownership only can be transferred to a person entitled to the same discount. In this event, the emailed application shall have digital copies attached of the documents confirming the right to the discount of the person whose data is specified in the personalized ticket and the person to whom the ownership of the personalized Ticket is transferred.

5.3. Reasons for Denial of the Right of the Customer Bearing a Ticket to Visiting the Museum

The Museum shall reserve the right to denial of the right of the Customer bearing a Ticket to visiting the Museum if said Customer breaks the Rules of Conduct in the Museum. The effective version of the Rules shall be found anytime at the Museum’s official site at the URL https://arsenal-museum.art.

5.4. Provision of Security of the Payment Procedure

The Security of the Payment procedure shall be provided by the Acquirer Bank functioning on the basis of the up-to-date protocols and technologies developed by the payment systems Visa International, Masterсard Worldwide (3D-Secure: Verified by Visa, Masterсard SecureCode), and MIR, and Online Payment Systems. The security of data being transferred shall be provided by the Acquirer Bank through up-to-date protocols designed for ensuring Internet data transfer safety.

5.5. Annulling the Order

  1. The Museum shall annul the Order if the Customer unilaterally rejects the Order.
  2. The Museum shall annul the Order automatically on expiry of the Term of Reservation if the Payment System does not notify the Museum of the successful Payment therefor.
  3. The Museum shall reserve the right to annulling of the Order if the Ticket System experiences malfunction when the Order is being created. The sum amounting to the Cost of the Order shall in this event be returned to the Customer’s account which has been used for Payment therefor in accordance with Clause 7 hereof.
  4. The Museum shall reserve the right to annulling of the Order if the Event has been cancelled or substituted for by the Museum. The sum amounting to the Cost of the Order shall in this event be returned to the Customer’s account which has been used for Payment therefor in accordance with Clause 7 hereof.

5.6. Informational Support Provided to the Customer

If the Customer experiences difficulty in creating the Order and effecting the Payment, they may address the Museum by emailing to the address of the ticket sales support service tickets-nn@pushkinmuseum.art.

5.7. Refund of Payment for a Digital Order

  1. The amount of Payment for the Digital Order which has been paid for, but not used can only be returned for the case of Orders which have been created at the Museum’s Site with the help of a Bank Card or Online Payment System. The funds shall only be returned to the Customer’s account which has been used for effecting the Payment.
  2. A Ticket which has been used fully or partially (for entry to one of the zones where said Ticket is valid or for being present at only some of the Events for visiting which the multi-event Ticket has been issued) shall not be subject to a Refund.
  3. A Refund can only be effected for the entire Order, i. e. for all Tickets constituting the Order. If a number of the Tickets constituting the Order have been used, the remaining Tickets cannot be subject to a Refund with the exception of cases specified in Clause 7.10 hereof.
  4. A partial Refund of the Payment for a Ticket issued for a number of Events (referred to as multi-event ticket) may not be effected on expiry of Terms specified in Clause 7.1 hereof, even if the Customer failed to attend any of the Events specified.
  5. A Ticket cannot be replaced by another Ticket issued for a different date, different session, or different Event, or by a Ticket of different price, not even if the Customer offers to cover the difference of the cost.
  6. In order to have a Refund of a Payment, the Customer shall fill in the /online form of the Claim/ prior to expiry of the Terms specified in Clause 7.1 hereof. The Claim shall have the same email address specified as the one which was specified by the Customer when creating the Order.
  7. When the Museum receives the Claim, the automatic notification on the Claim reception is generated and sent to the address of the claimant. If no such notification has been received, the Customer may address the Museum using the contact details specified in Clause 5.6.1 hereof in order to obtain the confirmation of the reception of the Claim by the Museum. If the Customer fails to address the Museum for such confirmation, the Museum shall bear no responsibility for failing to receive the Customer’s Claim.
  8. The Museum shall process the Customer’s Claim for a Refund of the Payment if and only if the Customer fully meets the conditions specified in Clause 5.7 hereof. The term of processing of the Claim shall be ten (10) calendar days.
  9. The date of the Refund of the Payment shall be the date on which the funds were withdrawn from the Acquirer Bank’s suspense account. The Museum shall bear no responsibility for further transactions to which the funds may be subjected.
  10. If the Refund of the cost of the Order is effected after the expiry of the terms specified in Clause 7.1 hereof due to the well-documented facts connected with the illness of the Customer or another person who is a member of their family, or the death of a person who is a member of their family or their close relation (in accordance with the Family Code of the Russian Federation) the Museum shall refund the cost of the Order only if the following terms of submission of the Claim and confirmation documents (or digital copies thereof) to the Museum are met:
    • in connection with an illness: the Claim latest on the date of the visit specified in the Ticket; a temporary disability leave or a doctor’s note latest 14 days starting from the date of the visit specified in the Ticket constituting the Order;
    • in connection with a death: the Claim latest on the date of the visit specified in the Ticket; confirmation documents (the death certificate and documents certifying the relationship) latest 14 days starting from the date of the visit specified in the Ticket constituting the Order.
  11. The term ‘members of the Customer’s family’ shall herein mean spouses, parents, and children (including adopted children); the term ‘close relations’ grandparents, grandchildren, and siblings.
  12. In the event of an illness the Customer shall confirm the fact of illness by the following documents (digital copies thereof): a temporary disability leave, a doctor’s note of the form 095/y (for students of schools and higher education establishments), or a certificate issued by the respective medical agency as prescribed by the effective law of the RF confirming the illness of the Customer which prevented them from visiting the Museum, and digital copies of documents confirming relationship (for the case of an illness of a family member).
  13. In the event of death of a relation the Customer shall confirm the fact of the death by the following documents (digital copies thereof): a registered death certificate issued by the respective medical agency of the form 106/y-08 or a certificate (notification) of the fact of death issued by the office of civil registry (provided that the death occurred latest 14 days prior to the date of visit specified in the Ticket, but not after the date of visit or prior to the date of the Purchase of the Tickets by the Customer) and digital copies of documents confirming relationship.
  14. To claim a Refund for the cases specified in Clause 5.7.10 hereof, the Customer shall fill in the /online form if the Refund Claim/ attaching the digital copies of the documents to confirm the reason for such application and of the identity document of the Customer. The term of processing of the Claim and notification of the Customer on the decision taken shall be ten (10) work days starting from the moment of reception of such Claim. The moment of reception of such Claim shall be the moment when the Claim is received by the automatic processing system of the Museum.
  15. In order to process the Refund the Museum can also ask the Customer to produce the Ticket and the Till Slip.
  16. The Museum shall reserve its right to rejection of a Refund for the case of Tickets sold within the scope of special programmes or actions where special conditions of the Purchase of Tickets apply (including discounts and reduction of prices).
  17. The Museum may set a limit to the number of Tickets produced by a single Customer and subjected to a one-time Refund or reject a Refund Claim if:
    • a) the Customer fails to submit the documents required for the Refund Claim processing;
    • b) the Customer has submitted documents containing false information;
    • c) the Customer fails to meet the Terms of the Claim submission provided by Clause 7.1 hereof;
    • d) death of the Customer’s family member or close relation occurred after the Date of Visit specified in the Ticket, after the date of the Purchase of the Tickets, or 14 or more days prior to the Date of Visit;
    • e) it has been established that the Customer submits Refund Claims regularly (more frequently than two times a month);
    • f) the Claim refers to more than one Order;
    • g) it has been established that the Customer purchased Tickets for commercial use;
    • h) it has been established that the Tickets were re-sold by persons or entities who had not been authorized by the Museum to re-sell Tickets in the manner prescribed by the effective law of the RF.
  18. When effecting a Refund for the reason of cancellation or replacement of an Event initiated by the Museum, or in the events of malfunctioning leading to the impossibility of creating an Order or effecting the Payment, the Museum shall inform the Customer regarding the cancellation, replacement, or transfer to a different date of the Event by putting out information messages on the Museum’s Site. Refund Claims can be received by the Museum starting from the moment when such information messages on the cancellation, replacement, or transfer to a different date were made available to public on the Site and within ten (10) days following the initial date of the Event. The Museum also may annul the Order and return the full amount of the Payment to the Customer even if the Customer has not submitted a Refund Claim.
  19. The Parties have hereby agreed that the Refund of the Payment by the Museum which concerns a respective Order in accordance with the provisions hereof and/or the Rules of Use of respective Payment Systems and the effective law of the RF shall be construed by either Party as a rationale sufficient for the Museum to terminate its liabilities stipulated hereunder and deem its liabilities to the Customer completely fulfilled.

6. Rules of the Ticket Purchase and Refunds Done at the Ticket Offices

  1. The Currency of Payment and refund
    • The Currency of Payment in accordance with the effective law of the RF shall be the Russian Rouble.
    • The Currency of Refund in accordance with the effective law of the RF shall be the Russian Rouble.
  2. The Payment for the Tickets at the Ticket Offices may be effected with physical currency, a Bank Card, or an Online Payment System.
  3. The Customer only can purchase a reduced-price Ticket from the Ticket Office if they produce a document confirming their eligibility for such discount.
  4. The Customer only may dispose of their right to purchasing a reduced-price Ticket from the Ticket Office one time in a day.
  5. A Ticket which has been used fully or partially (for entry to one of the zones where said Ticket is valid or for being present at only some of the Events for visiting which the multi-event Ticket has been issued) shall not be subject to a Refund.
  6. A partial Refund of the Payment for a Ticket issued for a number of Events (referred to as multi-event ticket) may not be effected on expiry of Terms specified in Clause 7.1 hereof, even if the Customer failed to attend any of the Events specified.

7. Terms of Refund Claims

The term during which the Ticket is eligible for a Refund shall depend on the type of the Ticket. The moment when the Refund Claim is received by the CRM system of the Museum or when the hard-copy Refund Claim is submitted to the Ticket Office of the Museum shall be the time of the reception of the Refund Claim. The Museum shall reserve the right to rejection of the Claim if the time of reception does not meet the following terms.

8. Confidentiality of the Customer’s Personal Data

  1. The Museum shall not divulge information received from the Customer. Submission by the Museum of such data to the persons and entities acting on the basis of a contract with the Museum needed for fulfilment of the Museum’s obligations to the Customer shall not be deemed divulgence of such data. The Museum shall disclose the Customer’s personal data only to those staff, contractors, and agents, for whom such disclosure is necessary to provide the Site’s functioning and to render services to the Customer.
  2. The Customer’s personal data shall be processed in accordance with the effective law of the RF. The Museum shall process the Customer’s data for the purpose of rendering services to the Customer, checking, researching, and analyzing the data, and for keeping in touch with the Customer. The Museum shall resort to all reasonable necessary means to protect the Customer’s data from unauthorized access and illegal circulation.
  3. Accepting the conditions of this User Agreement, the Customer thereby shall express their consent for the both automatic and manual processing of such data including processes of collection, classification, accumulation, storage, specification, use, circulation (including disclosure to third Parties), anonymization, protection, and deletion of such personal data submitted by the Customer under this Agreement, and for other operations with such data provided by Federal Law of July 2006 152-FZ, On personal data.
  4. The Museum shall not be checking authenticity or validity of the data submitted by the Customer, but shall assume that the data submitted by the Customer in the process of creation of an Order are authentic, valid, and sufficient, and that the Customer shall be liable for informing the Museum on any changes taking place in the data previously submitted. The Customer shall bear the entire responsibility for submission of unauthentic or invalid data.
  5. The Museum may use the data submitted by the Customer for such legal purposes as are applicable within the effective law, including prevention and/or stopping of illegal and/or illegitimate actions of the Customer. Disclosure of the information submitted by the Customer can be effected only in accordance with the applicable laws of the RF following a request issued by the court or law-enforcement agencies or in other similar legally provided for cases.
  6. The Customer shall be responsible for preservation of the information regarding the Tickets purchased, and of the unique number and details of their Order.
    • The Museum shall not be held responsible for admission into the Museum of a Ticket bearer who is not the rightful holder of the Ticket, and can deny the right to entry to the Event to all Ticket bearers whose Tickets have identical bar codes or QR codes.
  7. The Customer shall be solely responsible for preservation of the hard-copy Ticket (accountable form) purchased from the Ticket Office. A second issuance of the Ticket is not available.

9. Disclaimer

  1. The Customer shall use the Site and its features and functionalities at their own risk. The Museum shall not be held responsible for the Customer’s manner of use of the Museum’s Site or for the fact that the opportunities offered by the Site meet or fail to meet the expectations or purposes of the Customer.
  2. The Museum shall be fully exempt from any responsibility as regards any contractual relationships between the Customer and third Parties.
  3. The Museum shall not bear responsibility for Tickets which have not been purchased from the Ticket Offices of the Museum, at the Site of the Museum, or from the persons or entities authorized by the Museum to distribute Tickets, and cannot guarantee that such Tickets should be authentic. In the event when such Tickets are produced for the Ticket Inspection, the Museum may deny the Customer the right to entry and confiscate such Tickets.
  4. The Museum may, fully of its own accord, stop the operation of the entire Site or part thereof without a prior notification of the Customer. The Museum shall not be held responsible for a temporary or continuous disruption of the operation of the Site.
  5. The Museum shall take all possible efforts to ensure normal operation of the Site. However, the Museum shall not be liable for non-fulfilment or improper fulfilment of the Museum’s obligations hereunder to the Customer as regards indemnity of direct or indirect loss or damage caused by unavailability of the Site and its features or functionalities in any event.
  6. In the event of acts of God, breakdowns, disruptions of operation of soft or hardware of a third Party collaborating with the Museum or acts or omissions of a third Party aimed at suspension or disruption of operation of the Site, the operation of the Site may discontinue without any prior notification of the Customer.
  7. The Museum shall not be held liable for banks or other agencies failing to meet the terms of Payments or Refunds.
  8. The Museum’s liability to the Customer shall be limited to the amount equal to the Costs of the services purchased by the Customer.
  9. The Parties hereto shall be exempt from responsibility for full or partial non-fulfilment of their obligations hereunder if such non-fulfilment was due to a force majeure circumstance emerging after coming of this Agreement into effect as a result of an act of God which the Parties could not have foreseen or prevented by reasonable means.
  10. The Museum shall be exempt from any liability as regards disputes or disagreements in connection with Payments which may arise between the Customer and a Payment System and/or a lending agency.

10. Final Clauses

  1. In the event of variations of reading of different texts of the Agreement, the text of this Agreement uploaded to the Site shall prevail.
  2. Unless provided otherwise in this Agreement, the relationships between the Customer and the Museum shall be governed by the effective law of the RF.
  3. In the event of emergence of disputes or disagreements regarding this Agreement and the scope hereof, the Museum and the Customer shall take all possible efforts to resolve such by way of negotiation. If it appears impossible to resolve a dispute by way of negotiation, such shall be resolved in court in accordance with the effective law of the RF.
  4. The Customer shall hereby attest that they have got themselves informed as regards and fully (i.e. without any additional provisions) accept the conditions of this Agreement. The Customer shall hereby take on the responsibility to comply fully with the provisions of this Agreement in their relationships with the Museum.
